1. Who We Are

CDP Fencing & Land Cultivation LLC, doing business as CDP Fencing (“CDP Fencing,” “Company,” “we,” “us,” or “our”), is a fence installation and land cultivation contractor serving Columbia, Lexington, Irmo, Chapin, Orangeburg, Aiken, Sumter, and the surrounding areas of Richland County, South Carolina.

These Terms & Conditions (“Terms”) govern your use of our website at https://cdpfencing.net (the “Site”) and the services we provide. By using the Site, submitting a form, or engaging us for work, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.


2. SMS Messaging Terms & Compliance

2.1 Program Description

CDP Fencing & Land Cultivation LLC (DBA CDP Fencing) sends text messages to customers and prospective customers who have expressly opted in to receive them. Opt-in is collected through a dedicated, unchecked consent checkbox on our website forms, landing pages, and appointment booking forms at https://cdpfencing.net, or by direct request from you.

Depending on which consent you give, messages may include:

  • Non-marketing messages: replies and follow-up about a fence quote or estimate you requested, appointment confirmations and reminders, scheduling and rescheduling updates, crew arrival and project status updates, and customer support.
  • Marketing messages: seasonal offers, discounts, service promotions, and requests to review the work we completed for you.

Marketing consent and non-marketing consent are collected as two separate checkboxes, so you may agree to one, both, or neither. Consent to receive text messages is not a condition of purchasing any goods or services from us, and is never required to submit a form.

2.2 Cancellation / Opt-Out Instructions

You can cancel the SMS service at any time. Just reply “STOP” to any text message you receive from us. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

2.3 Help & Support

2.4 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

2.5 Message Frequency, Message & Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your active quote, appointment, or project; most customers receive fewer than 10 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

2.6 Supported Carriers

Our SMS program is supported by all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers.

2.7 Age Restriction

You must be 18 years or older to participate in our SMS program.

We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.


3. Our Services

We provide fence installation and related land cultivation services, including on-site estimates, material selection, permitting guidance where applicable, installation, and warranty support. Descriptions, photos, and pricing information on the Site are provided for general information and do not constitute a binding quote.


4. Quotes, Estimates, and Agreements

Any price we discuss before an on-site visit is a preliminary estimate only. A binding price is provided in a written quote or contract after we assess the property. Final pricing may change based on property conditions, access, grading, utility locations, permit requirements, material availability, and changes you request.

Work begins only after a signed agreement and any required deposit. Scheduling is subject to weather, permitting, utility locate services, and crew availability, and dates communicated to you are estimates rather than guarantees.


5. Payment and Refunds

Payment terms, deposits, and balances are set out in your written agreement with us. We issue refunds for contracts within 30 days of the original purchase of the contract, subject to deductions for materials ordered, custom fabrication, permits obtained, and work already performed. Refund requests should be sent to dsease@cdpfencing.net.

You represent that you have the legal right to use any payment method you provide and that the information you supply is true and complete. We may use third-party payment processors, and your payment information is handled in accordance with our Privacy Policy.


6. Property Access and Customer Responsibilities

Where we perform work on your property, you agree to provide safe access to the work area, disclose known underground utilities, irrigation lines, septic components, and property line disputes, and confirm that you are the owner or are authorized by the owner to approve the work. You are responsible for obtaining homeowner association approval where required.


7. Acceptable Use of the Site

You may use the Site only for lawful purposes. You agree not to:

  • Use the Site in any way that violates any applicable law or regulation
  • Send junk mail, chain letters, spam, or unsolicited solicitations through the Site
  • Impersonate CDP Fencing, our employees, or any other person or entity
  • Use any robot, spider, scraper, or automated means to access or copy material from the Site without our written consent
  • Introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to the Site or its servers
  • Interfere with, overburden, or disrupt the Site or anyone else’s use of it
  • Post or submit false, misleading, or fraudulent information, including false reviews or ratings

8. Intellectual Property

The Site and its content, including text, project photographs, graphics, logos, and design, are the property of CDP Fencing & Land Cultivation LLC or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages of the Site for your personal, non-commercial use, provided you keep all proprietary notices intact. The Site may contain links to websites operated by third parties. We do not control and are not responsible for the content, privacy practices, products, or services of those websites, and linking to them does not imply endorsement. 11. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

This section applies to the Site only. Any warranty covering the fence installation or other work we perform for you is set out separately in your written agreement with us and is not limited by this section.


12. Limitation of Liability

To the fullest extent permitted by law, CDP Fencing & Land Cultivation LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to your use of the Site. Where liability is found, it will be limited to the amount you paid to us for the products or services giving rise to the claim. Some states do not allow certain limitations, so parts of this section may not apply to you.


13. Indemnification

You agree to indemnify and hold harmless CDP Fencing & Land Cultivation LLC, its officers, employees, and agents from claims, damages, liabilities, costs, and expenses arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

Any dispute arising under these Terms will be brought in the state or federal courts located in Richland County, South Carolina, and you consent to the jurisdiction of those courts.


16. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.


17. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the revised Terms.
